Hold Harmless statement

    Does anyone have a “Hold Harmless” statement in their client agreement regarding their network or cloud services being hacked? If so, would you be willing to share the language used?

    Kevin – I do not but I fear that a Hold Harmless (HH) statement may not hold up in court. I am sure I signed a HH when I got my annual Equifax credit report but look how that turned out.

    I am considering (but haven’t bought it yet) a Data Breach/Infection (Cyber) coverage endorsement. This would help if I was to be hacked and a client sued I think.

    Thank you for your input. I checked into the coverage from Lloyd’s. There quote for E&O plus their Data Breach coverage is similar to another policy I had quoted that only included E&O. That sounds like the prudent route to take.
