I don’t know if anyone has mentioned this before, but I just learned of a new scam targeting LLC’s. I received a very legitimate looking form entitled “2019 BIENNIAL STATEMENT INSTRUCTION FORM (New York LLC’s)” sent to my LLC business address stating “New York laws require limited liability companies registered to do business in the State to timely file a biennial statement every two years. If (my LLC name – Money Matters Professional Services, LLC) does not file a biennial statement within 60 days after the due date, it may be prevented from completing certain business transactions.” It goes on to cite law that an LLC is required to biennially file….etc. It then states “If the business entity is still in use, CPS Filing Services, a private entity, will assist for a fee in the filing of your biennial statement.” It then says that if you want to utilize this service, follow the steps, complete the form, and respond with $100. I know the State of New York sends out their own statements with a nominal fee. Although this appears to be a legit company, the statement can be misleading. It may give the impression that this is your official filing notice and $100 is required when in fact, you should be receiving the official notice from the state and paying approximately $9.00. Read the letter carefully…it does state CPS is a private entity that will assist in the filing “for a fee”. After researching online, LLC’s from other states have received this “BIENNIAL STATEMENT” as well.
